Hemp Registry

During the 2014 Legislative Session, Utah lawmakers passed HB 105 allowing Utah residents, or their dependents, who are being treated for intractable epilepsy to possess hemp extract as a means of treating their disease. Anyone wishing to legally possess hemp extract under Utah state law must obtain a hemp extract registration card from the Utah Department of Health.

The Department began issuing cards on July 8, 2014 at its main office located at 288 North 1460 West (Garside Ave.) in Salt Lake City.

Applicants for hemp extract registration cards must submit a completed application packet to the Office of Vital Records and Statistics. A complete application packet includes:

Applicants must also supply the following: Proof of identity or Utah residency, legal guardianship documents (if the patient is a minor or has a legal guardian), and a $200 application fee.

Once issued a hemp extract registration card, an individual should learn what additional steps must be taken in order to legally possess hemp extract in the State of Utah.

Utah Code 58-37-4.3 describes standards for legal possession of hemp extract. These standards include obtaining the hemp extract's certificate of analysis from the seller. Once purchased, the certificate of analysis must be kept in close proximity to the hemp extract. The laboratory responsible for the hemp extract's production must email OVRS a copy of the extract's certificate of analysis at hempregistry@utah.gov.
